Kieran Wallace and Andrew O’Leary were appointed as Joint Provisional Liquidators of the Company on 31 January 2025. The Company is no longer in a position to provide you with the payment services which allowed you to receive products/services from Avid Technology Inc. ("Avid").
To allow you to seamlessly continue to receive Avid products/services, the information you provided to the Company in order to receive those products/services has now been transferred to Avid, which is now the Controller of this data for the purposes of the EU's General Data Protection Regulation (GDPR). The legal basis of the transfer is the legitimate interests of the parties in continuing your customer relationship with Avid.
Your personal data has been transferred to Avid in the United States as part of fulfilling a contract in your interest between the Company and Avid. This transfer is necessary under Article 49(1)(c) of the GDPR to facilitate the continuation of your customer relationship with Avid.
Although this transfer is not based on the EU-US Data Privacy Framework, the United States is generally considered a lower-risk country for data protection, as organisations certified under the Framework benefit from recognised safeguards. Furthermore, measures such as encryption have been taken to further protect your data.
The basis for a transfer such as this is set out in the Digital River Privacy Statement, which is available here, which states:
"If one of our corporate affiliates or a third party has acquired our business, specific assets or the business of one of our operating divisions (such as part of a sale, merger, reorganization, or similar event), your Personal Data will become owned by that company, unless otherwise provided for by local legislation. In that event, the acquiring company's use of your Personal Data will be subject to the governing Privacy Policy, any applicable supplemental privacy notices, and the privacy preferences you have expressed to Digital River prior to merger."
Avid is now the controller of your personal data for the purposes of the GDPR, and they have provided you with their contact details.
